Who we are

Here are the general terms and conditions of Maan B.V. Bonaire, hereinafter referred to as ‘Maan Property Management’, located at Kaya JNE Craane 24, Kralendijk, Caribbean Netherlands.

These terms and conditions apply to all services of Maan Property Management and to any use of the website www.maanbonaire.com, telephone reservations, and underlying web pages (hereinafter referred to as the ‘website’).

By using the website, you agree to these general terms and conditions. Maan Property Management reserves the right to change these General Terms and Conditions at any time without prior notice.

Cookies

Reservation

Guests can reserve a stay at Maan Property Management through the contact system on our website or directly via info@maanbonaire.com or +599 701 6066. Guests making a reservation must be over 21 years old. Depending on the timing of the reservation, guests will either pay a downpayment or the full amount of the reservation. The applicable rates at the time of booking via the website will apply. Maan Property Management reserves the right to decline a reservation or to attach additional conditions to the acceptance or execution of a reservation at any time.

The rates listed on the website are inclusive of ABB and exclusive of service charges and island taxes (tourist tax) unless otherwise stated. Payment can be made by credit card or bank transfer. The total payment is required four (4) weeks prior to arrival. Maan Property Management reserves the right to change rates and payment options without prior notice for justifiable reasons. If payment is not made (timely), you will be in default without the need for prior demand or notice of default. If you remain in default despite payment or notice of default, Maan Property Management has the right to transfer the claim to a third party.

In the event of no-show, cancellation, or modification of a reservation within 30 days of the arrival date, you will be charged the full reservation amount, excluding tax and service charges. For no-shows, cancellations, or modifications 31 days or more before the arrival date, you will be charged the amount of the deposit, excluding tax and service charges. Please contact us for options to change dates at no additional cost. Since Maan Property Management provides services related to accommodations and/or recreational services that occur within a specific period or on a specific date and/or time, the legal provisions that give guests the right to enter into and terminate a distance agreement without providing reasons do not apply to the agreement concluded via the website or for the services provided.

By making a reservation, the guest acknowledges that the use of the hotel and its indoor and outdoor facilities, including the garden, swimming pool, pool deck, and access to the pier and water taxi, is entirely at their own risk.

The guest hereby accepts all risks of injury (to themselves or death) for themselves, their family, and their guests during their stay at the hotel and/or while using the hotel facilities. By accepting the risk of injury (and death) as described above, they understand that they will fully relieve and indemnify the hotel and/or its employees from any loss, costs, claims, damages, and liabilities for personal injury or death resulting from or related to the rental and/or use of the hotel or any of its indoor or outdoor facilities. This indemnity obligation also applies to the guests’ family, and the main guest will ensure that they are informed of these terms and conditions.

The guest and those accompanying them are jointly liable for any damage, directly or indirectly, to the hospitality business and/or any third party that arises as a result of a attributable breach and/or wrongful act, including violations of house rules committed by the customer and/or the guest and/or those accompanying them, as well as for any damage caused by any animal and/or any property that they own or have under their supervision.

Maan Property Management’ liability in relation to an attributable breach of its obligations and/or in connection with wrongful acts or otherwise is limited to compensation for direct damage suffered by you up to an amount not exceeding the total price you paid to Maan Property Managementfor the services from which the liability arises. In no event will Maan Property Management’ total liability for direct damage of any kind exceed $500.

Only the following damages will be considered direct damages:

a. damage to property;

b. reasonable costs associated with determining the cause and extent of the damage, insofar as this determination relates to direct damage as described in these terms;

c. reasonable costs associated with preventing or mitigating damage, insofar as you can demonstrate that these costs led to the limitation of direct damage as described in these terms.

Maan Property Management’ liability for other damages than direct damages (‘indirect damages’), including but not limited to moral or consequential damages, lost profits, lost opportunities, loss of information, costs incurred in connection with this website or any website linked to it, or for damages arising from the use or inability to use the website, software algorithms, or linked websites due to interruptions, defects, delays in operation or transmission, computer viruses, or line or system failures, is expressly excluded.

The restrictions mentioned in the preceding paragraphs of this article shall lapse if and to the extent that the damage results from intent or gross negligence on the part of Maan Property Managementor its executives (‘own actions’).

A condition for the right to compensation is that you report the damage to Maan Property Managementas soon as possible after it occurs. Any claims against SENSES that are not submitted within 3 months after the occurrence of the claim will no longer be admissible.
